Terms & Conditions

By contacting Wildflower Moon Retreats through the booking form there is no contractual agreement that the event will be held on that date and/or time. Neither the client nor Wildflower Moon Retreats is in an agreement until the client has filled out the "Booking Contract" that will be sent over email from Wildflower Moon Retreats AND client has made a payment.

In the case of adding persons to an event past initial payment, the client must inform Wildflower Moon Retreats and pay for those persons no later than 1 day prior to the event. 

​

Information provided in the booking form will be shared only with Wildflower Moon Retreats. Information provided will only be used to contact clients for booking.​ Information provided can not be used by Wildflower Moon Retreats for further marketing unless requested by the client.

​

Wildflower Moon Retreats reserves the right to decline service to anyone. In the case of feeling unsafe or uncomfortable Wildflower Moon Retreats reserves the right to leave the event to prioritize their safety and wellness

1. Agreement to Terms and Conditions

1.1  These Terms and Conditions constitute a legally-binding agreement made between you, whether personally or on behalf of an entity (you) and Wildflower Moon Retreats (referred to in these terms as “WFM” – the words “we”, “us”, “our” and similar words also refer to “WFM”), concerning any Offering or Retreat purchased from WFM. 

 

1.2 You agree that by attending an Offering or Retreat, you have read, understood, and agree to be bound by these Terms and Conditions.

 

1.3 Because we can change these Terms and Conditions from time to time, we do recommend that you print off a copy and keep them safe. The updated version of these Terms and Conditions will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. You are responsible for reviewing these Terms and Conditions to stay informed of updates.

 

1.4 We want and expect you to be delighted with any Offering or Retreat purchased from WFM. If you have any complaints, please email us at wildflowermoonretreats@gmail.com and give us the chance to investigate and, if relevant, try to put things right for you.

 

2. Eligibility

2.1 To be eligible to purchase and/ or attend an Offering or Retreat from WFM you must be 18 years of age or over. 

 

2.2  If you are booking an Offering or Retreat from WFM, you must: 

        a. provide your real name, phone number, email address, and other requested information as specified on the WFM              Booking Contract ;

        b. sign and date the WFM Booking Contract to confirm that you have read and accepted all the Terms and                               Conditions outlined on the WFM Website,  and secure the booking by paying the amount required in the WFM                     Contract.

 

3. Making a Contract

3.1 Your booking through Wildflowermoonretreats.com  is a request to purchase a Offering or Retreat from WFM. When you are making a booking, the following steps have to take place before a contract is made between us. 

Complete the WFM Booking Form 

        a. On receipt of your Booking Form, WFM will email an acknowledgement of your booking request followed by                        communication to book an Offering or Retreat. 

        b. Once all details are agreed upon by client and WFM, WFM will email a contract.

        c. You will have 5 days from the date and time when the WFM Contract is sent to you in which to secure your booking               by filling out and returning the WFM Contract. Once you have paid a deposit for the Offering or Retreat you are                   guaranteed the Offering or spot on the Retreat. If your deposit is not paid within 48 hours of submitting the WFM                 Contract, we reserve the right to cancel your Offering or Retreat.

        d. You will receive an email confirming your booking shortly after we receive payment of your deposit along with an                   attachment containing a receipt for your payment (“Confirmation Email”). 

        e. We accept your booking at the time you receive the Confirmation Email. Nothing that we say or do will amount to                 any acceptance of your booking until you receive the applicable Confirmation Email, at which point a contract will                 be made between us unless, before your receipt of the Confirmation Email, we have notified you that we do not                   accept your booking. 

3.2 We may decline your booking request for any reason, in which case you will receive an email telling you so.

 

4. Prices and Payment

4.1 The prices for Offering and Retreats with WFM will be shown on our Website. We use our best efforts to ensure that the prices of Offering(s) and Retreat(s) are correct at the time of being uploaded to the Website. If we discover an error in the price of any Offering or Retreat you booked, please see clause 4.2 below for what happens. 

 

4.2 Although we will endeavor to ensure that all information on our Website is accurate, occasionally errors may occur. This is what happens if we discover an error: 

            a. If we discover an error in the description of an Offering or Retreat that you have booked, we will let you know                         and ask whether you wish to continue with your booking or cancel it. 

            b. Where the Website showed a price which was too high, we will charge the lower amount when confirming the                        booking to you with a Confirmation Email. 

            c. Where the Website showed a price which was too low, we do not have to provide the Offering or                                             Retreat to you at the incorrect (lower) price. We will contact you as soon as possible to inform you of this error                       and we will give you the option of continuing to purchase the Retreat at the correct (higher) price or cancelling                     your order. We will not process your booking until we have your instructions. If we are unable to contact you                           using the contact details you provided during the booking process, we will treat the booking as cancelled and                       notify you in writing. 

 

4.3 Prices for Offering(s) and Retreat(s) may change from time to time, but changes will not affect any booking which we have already confirmed with a Confirmation Email. 

 

4.4 We currently accept payment for Retreats by cash. Venmo or Zelle. By placing your booking, you confirm that the money and/or account that you use to make payment to us is yours and that you have authority to use that money and/or account. 

 

4.5 If we are unable to supply the Retreat, we will let you know as soon as possible. We will give you a full refund if we have already taken payment for a Retreat that we can no longer supply. 

 

4.6 Payment for the Retreat is due 16 weeks in advance of the specific Retreat you wish to attend, unless otherwise stated. Late payment (without prior written consent) will result in you losing your booked space on the Retreat and any money previously paid being lost, unless discussed prior with WFM and information was amended within the contract.

 

5. Exclusion and Limitation of Liability

5.1 There are certain liabilities which we cannot exclude by law and nothing in our contract with you excludes or limits our liability for the following things: 

           a. death or personal injury caused by our negligence; 

           b. fraud or fraudulent misrepresentation; or 

           c. any other thing for which we are not legally allowed to limit (or try to limit) our liability or obligations to you. 

 

5.2 You have certain rights as a consumer, including legal rights relating to Offerings and Retreats that are faulty or not as described. Our terms already reflect those legal rights and nothing in our contract with you will reduce them. For further information about your legal rights, please contact your local authority Trading Standards Department or Citizens Advice. 

 

5.3 We will not be responsible or liable for: 

        a. any losses related to any business of yours, including loss of data, profits, revenue, business, opportunity, goodwill             or reputation, or business interruption; or  

        b. any losses which were not something we could have reasonably expected (as consequences of us doing anything               wrong under our contract with you) when entering into that contract. 

 

5.4 We will not be in breach of our obligations under our contract with you if we are prevented or delayed from complying with those obligations by: 

         a. anything you (or anyone acting on your behalf) does or fails to do; or  

         b. events or circumstances beyond our reasonable control (including fire, flood, extreme weather, bio-emergencies,               strikes, trade disputes, lock-outs, restrictions of imports or exports, riot, accident, disruption to energy supplies, civil             commotion, acts of terrorism or war). 

 

6. Legal Matters

6.1 When you purchase an Offering or Retreat from WFM, you provide personal details, both for yourself and, if relevant, for other members of your group. By entering personal details for your group members (if any), you are promising (in legal terms, you are warranting) to us that you have their consent to do that. 

 

6.2 Some laws require that certain information or communications we send to you should be in writing. You agree that communicating with you by email, text message, notices on our Website or other text-based electronic methods counts as communicating with you in writing. 

 

6.3 If any part of our contract with you is found to be unenforceable as a matter of law, all other parts of that contract are unaffected and will remain in force. 

 

6.4 Any contract we form with you is personal to you. You may not assign, sub-license or otherwise transfer any of your rights under that contract. 

 

6.5 Nobody apart from us and the buyer of an Offering or Retreat has any rights under this contract. 

 

7. Specific Terms and Conditions

7.1. For Retreat bookings only: We must receive payment in full 16 weeks prior to the Retreat (as stated in our Cancellation and Refund Policy on our website) or otherwise specified on the contract sent for the specific Offering or Retreat you and all members of your party wish to attend. Failure to pay by the date specified, will result in your booking being cancelled.
 

7.2 For Retreat bookings only: Cancellations made less than 1 month prior to the retreat will lose all money paid to Wildflower Moon Retreats.

 

7.3 We will be entitled to require you to leave an Offering or Retreat if in our reasonable opinion you behave in an unacceptable manner. In this case, you will not be refunded for any money paid. 

 

7.4 You will be provided with our health and safety rules and other information by email before any booked Offering or Retreat. You and all other members of your party must carefully read the information in that email. If there is anything you do not understand relating to that information, please contact WFM. 

 

7.5 For Retreat bookings only: We work hard to cater for dietary requirements. Please ensure you complete the booking form with all your and your party’s dietary requirements, to ensure that WFM can tailor the menu to your needs. Failure to submit dietary requirements, will mean that those dietary requirements may not be catered for. 7.6 For Retreat bookings only: You are advised not to bring any items of special or high value onto our Retreats. We do not accept responsibility for damage to or the loss of any personal possessions. 

 

7.7 You agree and acknowledge that: 

           a. an age restriction of 18 years and above apply for all Bookings and Retreats. 

           b. cars parked are entirely at the owner’s risk. No responsibility can be accepted for loss of property or damage to                   vehicles whilst on site. 

 

8. Our Rights to Cancel or Reschedule

8.1 We may cancel any Offering or Retreat due to events or circumstances outside our reasonable control. 

 

8.2 If the Offering or Retreat is canceled by Wildflower Moon Retreats, for any reason, participants will receive a full refund of all money paid to WFM. However, WFM is not responsible for any other expenses incurred, such as flights, hotels, props, transportation, etc.

 

8.3 When reasonably possible, WFM will do their best to provide 2 weeks notice of cancellation. When reasonably possible, WFM will provide optional dates to reschedule.

8.4 By making your reservation, you are agreeing to the terms of the cancellation and refund policy which is printed above and posted on our website.

 

8.5 For Retreats only: Although it is rare for us to do so, we may reschedule any Retreat at any time. We may also change the location or content of any Retreat.

          a. If the new Retreat location is within 1 hour of the original Retreat location, a refund will not be issued. If the new                  location is farther than 1 hour from the original Retreat location, an option for a full refund of money paid to WFM                will be provided.

           b. If the dates of the retreat are changed, an option for a full refund of money paid to WFM will be provided. 

 

8.6 If we do cancel, reschedule or make any changes as described in clauses above, we will notify you by telephone or by email and will endeavor to do so as soon as possible after making those changes. 

 

8.7 We will not reimburse you for any travel or accommodation costs relating to a cancelled, changed or rescheduled Retreat. 

 

9. Your Right to Cancel Retreats (this is not applicable for Offerings) 

9.1 Our Retreats all involve accommodation, meals  and yoga-related services and we hold them on specific dates. The Retreats Cancellation and Refund Policy for WFM Retreats is stated on the Website and is specific to the dates of each Retreat. As our administrative hours are 8:00am -7:00pm Monday to Friday (excluding public holidays), notice received outside these hours will be treated as received on the next working day. 

 

9.2 In certain circumstances we permit you to transfer your booking to friends and family members if: 

         a. you notify us in writing at least 14 days before the start of the Retreat; 

         b. you provide the name and contact details of the person who will be taking your place; 

         c. the person taking your place accepts the same accommodation in your original booking and fulfils the eligibility                criteria as set out in clauses 2.1 and 2.2 above, and 

         d. a $25.00 administration fee is received for making that transfer. 

 

9.3 Failure to attend a Retreat without prior notification of cancellation in writing and in accordance with the terms of the Retreat Cancellation and Refund Policy for the specific Retreat as stated on the Website or leaving during the Retreat will result in a loss of any money paid. 

 

9.4 We strongly recommend that you obtain appropriate travel insurance prior to placing a booking for any Retreat to cover you in the event that you cannot attend a Retreat for unforeseen reasons, for example due to bad weather, transport delays or cancellations, illness or bereavement. Some banks automatically provide you with travel insurance cover – please check with your relevant insurance services provider(s) before booking with us.
